On this page

Until 2025, the answer to "is Teen Patti legal?" depended on where you lived and whether the game counted as skill or chance. That changed in August 2025, when Parliament passed a national law on online gaming. This page explains the law in plain language and what it means for anyone who plays Teen Patti on an app. For the latest developments, including the regulator's July 2026 order, see our Online Gaming Act 2025 update.

This is general information, not legal advice. Laws and court rulings change. If you need advice on your own situation, speak to a lawyer.

The short answer

  • Teen Patti with free chips, for fun, with no money in or out: not what the law bans. This is an online social game.
  • Teen Patti for money on an app or website: banned across India. The law bans offering these games, advertising them and processing payments for them, whether the game counts as skill or chance.

Is Teen Patti Master banned in India?

The money version is. Since 1 May 2026, offering Teen Patti for real money on any app, Teen Patti Master included, has been illegal across India under the Promotion and Regulation of Online Gaming Act, 2025. The law does not ban the game itself, so playing Teen Patti Master with free chips that cannot be cashed out is not what it targets.

What the ban means in practice:

  • App stores and banks have been told to cut money games off. On 29 July 2026 the Online Gaming Authority of India told app stores, banks, payment apps, telecom companies and advertisers to disable online money games and block their payments.
  • Deposits and withdrawals can stop without warning. If an app still takes money from Indian players, you have little protection when a withdrawal is refused or an account is closed. Our withdrawal problem guide covers what you can still do.
  • The ban stays in force while the Supreme Court hears the challenge. The Court has not stayed the Act.

The Promotion and Regulation of Online Gaming Act, 2025

Timeline

Date Event
20 August 2025 Bill passed by the Lok Sabha
21 August 2025 Bill passed by the Rajya Sabha
22 August 2025 Presidential assent. The Bill becomes an Act
8 September 2025 The Supreme Court transfers High Court challenges to itself
22 April 2026 The Promotion and Regulation of Online Gaming Rules, 2026 are notified
1 May 2026 The Rules take effect
29 July 2026 The Online Gaming Authority of India tells app stores, banks, telecom companies and advertisers to cut off online money games

Three kinds of online games

The Act divides online games into three groups:

  1. E-sports: organised competitive video gaming, which the Act promotes.
  2. Online social games: games played for entertainment or learning, with no money staked to win money. Free-chip Teen Patti fits here.
  3. Online money games: any online game where a player pays or deposits money (or something that stands for money) expecting to win money or other rewards. This applies whether the game depends on skill, chance or both.

The third point is the big change. Before 2025, many apps argued that Rummy or Teen Patti were games of skill and therefore legal in most states. The Act removes that argument for online money play.

What is banned

  • Offering online money games, or helping others offer them.
  • Advertising online money games, in any media, including by influencers and websites.
  • Financial facilitation: banks, payment apps and financial institutions may not process payments for online money games.

Penalties

According to the Act, as summarised in legal commentary:

Offence First time Repeat
Offering online money games Up to 3 years in prison and/or a fine of up to ₹1 crore 3 to 5 years and a fine of ₹1 crore to ₹2 crore
Advertising online money games Up to 2 years and/or a fine of up to ₹50 lakh Up to 3 years and/or a fine of up to ₹1 crore

Offering online money games is a cognisable and non-bailable offence.

What about players?

The Act is aimed at operators, promoters and payment facilitators. The government described players as victims of online money gaming rather than offenders. That does not make money play safe. It means that if you put money into an app that is breaking the law, you have almost no legal protection if it refuses to pay or disappears.

The regulator

The 2026 Rules set up the Online Gaming Authority of India, based in Delhi, to classify games, register them where required, handle complaints and issue directions to platforms and banks.

State laws

Gambling is also a state subject, and several states had their own bans or restrictions on online gaming before the central Act, including Telangana, Andhra Pradesh, Assam, Odisha, Sikkim, Nagaland and Meghalaya. State laws still apply alongside the central Act. If anything, they add restrictions. They cannot make online money games legal where the central Act bans them.

For what has happened since the law came into force, including the regulator's July 2026 order to app stores, banks and advertisers, read our Online Gaming Act 2025 update.

The Supreme Court challenge

Online gaming companies challenged the Act in several High Courts, arguing that it is too broad and harms legitimate skill-gaming businesses. On 8 September 2025 the Supreme Court transferred these cases to itself (the lead case is Head Digital Works v Union of India). The challenge is now before a three-judge bench led by Chief Justice Surya Kant, and it is still pending.

The Court has not stayed the Act. The Act and the 2026 Rules have applied since 1 May 2026 and will keep applying unless the Court rules otherwise. Check the latest news before relying on anything here.

What this means for the Teen Patti Master app

  • Using the app with free chips for entertainment is not what the Act targets.
  • If a build of the app, or any similar app, asks you to deposit money to play for cash, that is an online money game under the Act, and offering it in India is illegal.
  • Money features may disappear, payment methods may stop working, or apps may operate from outside India. Offshore operators are beyond the reach of Indian consumer protection in practice.
  • Websites and influencers who advertise money versions of these games face penalties under the Act.

Our advice is simple: do not add money to any gaming app. Play free-chip tables if you enjoy the game.

Taxes, for completeness

Before the ban, net winnings from online games were taxed at 30% under Section 194BA of the Income Tax Act, with tax deducted at source by the platform. That rule still exists in the tax law. It does not make money gaming legal.

If you already have money in an app

  • Stop adding more.
  • Try to withdraw what you can through the app's own withdrawal screen. Do not pay any "processing fee" or "tax" to a third party to release a withdrawal. That is a common scam.
  • Keep screenshots of your balance, transactions and support chats.
  • If you were cheated, call 1930 or file a complaint at cybercrime.gov.in.
